Augmentation Plans and Exchanges of Water

A plan for augmentation is a plan by which a water user is able to divert water out-of-priority and offset the impact of his or her water use by replacement with alternate sources of water. An augmentation plan may not injuriously affect the vested water rights of others and is governed by statutes, a growing body of Colorado Supreme Court case law and decisions of the water judges in the State's seven water divisions. With the help of technical experts, the firm of Moses, Wittemyer, Harrison and Woodruff, P.C. has successfully adjudicated many augmentation plans for its clients.
